Making a will

Held by humansLast reviewed 2026-08-18

A will is the act by which a person disposes of what is theirs for a moment when they will not be there to explain it. Because nothing can be asked of the author afterwards, the law asks a great deal of the act itself. French law voids a holographic will unless it is written in full, dated and signed in the testator's own hand. English law requires a signature made or acknowledged before two witnesses present at the same time. Software drafts wills by the thousand and does it well, and drafting was never the difficult part. What cannot be delegated is a person putting a name to a disposition that will be read against their heirs, and being, at that moment, of sound mind and free of pressure. A machine has no estate to leave and no one to leave it to.
